Terms of Service

1. Acceptance of Terms
By accessing or using SONAR and related services, including PULSE where enabled, provided by A&E Insights LLC, you agree to these Terms of Service. If you use the service on behalf of a campaign, committee, organization, or other entity, you represent that you are authorized to bind that entity and manage its users.
2. U.S. Elections Only
SONAR is offered only for U.S. elections and only to U.S.-based campaigns, committees, political organizations, candidates, and authorized U.S.-based users. Non-U.S. customers are not permitted to create accounts, purchase the service, or use the service.
3. Description of Service
SONAR is a political campaign CRM, call-time, donor relationship, outreach, and fundraising operations platform. The service may include contact management, call workflows, SMS and email tools, reporting, billing, integrations, and related administrative features.
- Access is delivered electronically after account provisioning, invitation acceptance, onboarding, or payment/order confirmation. No physical goods are shipped.
- Features may be updated, added, suspended, or discontinued to maintain, secure, or improve the service.
- We do not guarantee fundraising outcomes, voter/contact accuracy, donor eligibility, compliance outcomes, or uninterrupted availability.
4. Customer Responsibilities and Compliance
- You are responsible for account credentials, role assignments, authorized users, and all activity under your account.
- You are responsible for federal, state, and local election, campaign finance, donor eligibility, contribution limit, reporting, recordkeeping, and political disclaimer rules.
- You are responsible for TCPA/FCC rules, 10DLC and carrier requirements, CAN-SPAM, caller ID rules, consent, opt-outs, suppression lists, and all laws that apply to calls, texts, and emails.
- You may not use the service for unlawful communications, harassment, unauthorized scraping or resale, uploading unlawfully obtained data, bypassing opt-outs, compromising the platform, or sharing credentials outside authorized personnel.
5. Fees, Billing, and Taxes
- Access may require subscription fees, usage-based fees, implementation fees, or other charges stated in the applicable plan, order form, invoice, or in-product billing page.
- You authorize us and our payment processor to charge your payment method for amounts due. Usage-based charges may be billed in arrears at the end of a billing cycle.
- If you enable autopay, you authorize recurring card or ACH charges for amounts due. Disabling autopay stops automatic payment collection but does not by itself cancel an active subscription.
- Paid subscriptions renew at the stated billing frequency until canceled. You may cancel an online subscription from Billing settings or by contacting support.
- Fees are exclusive of taxes unless stated otherwise. We may collect applicable taxes where required, and you are responsible for taxes not collected by us.
- Failed or late payments may result in suspension, access limits, collection activity, or termination.
6. Refunds, Credits, and Cancellation
SaaS subscription fees, usage charges, and implementation fees are non-refundable except where required by law, expressly stated in a written order form, or approved by A&E Insights LLC in writing. Subscription cancellation takes effect at the end of the current paid billing period and stops future renewal. Disabling autopay does not cancel a subscription or waive charges already accrued. Approved credits may be applied to future invoices at our discretion.
7. Customer Data and Privacy
Your use of the service is governed by the Privacy Policy. You retain ownership of donor, contact, campaign, and committee data you provide. You grant us a limited license to process that data to provide, secure, maintain, support, and improve the service, operate integrations, generate aggregated or de-identified insights, and comply with law.
8. Warranty Disclaimer
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, fundraising results, compliance outcomes, and accuracy of third-party or customer-provided data.
9. Limitation of Liability
To the maximum extent permitted by law, SONAR, A&E Insights LLC, and their affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost data, lost funds, lost contributions, reputational harm, or campaign-related losses. Our total liability is limited to the amount paid by you to us for the service in the twelve months before the claim.
10. Suspension and Termination
We may suspend or terminate access if you violate these terms, fail to pay amounts due, create a security or legal risk, use the service unlawfully, trigger provider or carrier restrictions, or expose SONAR, users, donors, communications recipients, or third parties to harm.
11. Changes to These Terms
We may update these terms from time to time. Material changes will be posted to this page and may require renewed acceptance. Continued use of the service after updated terms are effective means you accept the updated terms.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of Arizona. Disputes are resolved through binding arbitration in Tucson, Arizona, except where injunctive relief is permitted.
